Which distinction does the contract publisher explain?

The NEC publisher's 19 June 2023 guidance distinguishes the defects date from the time available to correct individual defects. Its guidance explains that correction periods may vary and that their start basis can depend on notification, Completion and access after take over. It also cautions that liability is not simply extinguished at the defects date.

Pre-bid Review is independent and is not affiliated with NEC. This article is not legal advice. The executed edition, Contract Data, options, amendments and actual communications require qualified contracts and legal review. No contract text or official form is reproduced here.

What should a pre-bid review extract?

Avoid carrying a single label such as warranty ends into the programme without checking what the contract actually says. Keep the master date basis and the individual defect records connected but distinct.

Why can one date be insufficient for package planning?

Illustrative example. A fictional electrical package register has one field labelled defects date and another defect row with its own notified date. The bid team copies the defects date into that defect's correction-deadline field without checking the applicable period or start basis.

The reviewer marks that deadline unverified and requests the contract-data period and relevant notification, Completion and access records. No numeric correction period or entitlement is invented. The example shows a missing calculation basis, not a decision about breach, liability or when a real party must act.

How should the reviewed position reach the delivery team?

Retain the original source references, the qualified reviewer's calculation and the assumptions used. If access or another relevant event changes, reopen the affected defect record under the actual contract process instead of changing the master date by guesswork.

Do not use this worksheet to delay a notice, assume that all obligations end on one date, or calculate deductions. Obtain project-specific advice and preserve unresolved contractual questions in the issue register.

Common questions

What else should the bid team know?

Is the defects date every defect's correction deadline?

No. Reconcile the applicable correction period and its start basis separately.

Does the defects date automatically end all liability?

Do not assume that. Obtain qualified advice on the actual contract and law.

Does this register calculate a contractual deadline?

It records the source basis and reviewed outcome; it does not replace qualified contract review.
